fix the updater to allow for empty updates

this is useful for testing, and would allow us to push an update update if we ever needed to.

we might need to do this (one day), in order to ensure that helper.exe is run on windows (for example).

it also allows QA to test the full update flow with harmless empty updates (like http://www.sspitzer.org/empty.xml)

it's a two line fix that mscott, rstrong and I have been using on our own.

There hasn't been much need for this and I haven't been allowing empty updates in my testing for a very long time so I am going to resolve -> wontfix. I can almost see my way to wanting to be able to just run the helper but that can be done by just adding or patching a file as well which will likely be necessary to patch the helper to perform this type of one off.
