The items in the example do not have state FOCUSABLE either even though the selected item has state FOCUSED. This may be a separate bug. Feel free to open another bug if need be and please CC me :)

That is in fact a separate bug and most likely a bug with the ARIA spec itself. There's no way to indicate that something might become the activedescendant.

Scott, can you explain to me how this affects Orca? What if you were just to used FOCUSED?

Yes, FOCUSED will work for my purposes, however, this bug was reported because the listbox is not conforming to AT-SPI specification and it seems this information would be valuable to an AT. I would bump this bug down your priority scale if it is difficult and you are looking to prioritize bugs.
