Details
I just updated my copy of Nightly to FF38 and got the "You're now testing E10S..." infobar, but unlike in prior releases, it popped up _under_ tree-style tabs. It was impossible to close the infobar; I had to restart the browser.
This might very well be a bug in tree-style tabs, but given that this appears to be a fairly recent regression, it seems worth investigating.
