Software home button will cause the menu item overlay not cover to the whole screen

Details

1. turn on software home button (if it doesn't already have that turned on ... flame you will need to.  aries not so much )
a. go to settings -> developer mode -> enable software home button
2. launch browser
3. go to news.google.com or some other web page
4. tap the menu item button

Expected: the overlay fills the screen
Actual: there's a gap at the bottom

Happens on flame and Aries.
