The test case needs at least a double "try" clause to handle OOM within the allocation of the exception object in the inner OOM, but arguably the test case should perhaps be removed again or should allow for the OOM exit somehow - everything else is going to be extremely brittle.

I rewrote the test to use oomTest() which is more robust and verified that it still triggered the original problem.
