What is the bug? If the email uses tracking, there is a good chance it will appear at some point to be a scam. The criteria is fairly simple and is described here https://support.mozilla.org/en-US/kb/thunderbirds-scam-detection#w_thunderbirds-automatic-scam-filtering

Is Thunderbird not doing that?

Or is your issue that the scam detector should learn? Bug 320351
Or something else? Refer Bug 654502 for already files issues.
