Steps to recreate:
1) Set tabs to open in background
2) Set to "Ask before storing" cookies
3) Open a site that will ask you to set a cookie in a new tab.
4) Since the site is opening in the background, the cookie confirm dialog will
load as a dialog window, rather than a sheet.
5) Press Cmd-W to close the dialog (rather than clicking Yes or No, or hitting
escape).

Results:  Browser is not unusable.  Clicking on any part of the browser window
produces an error beep.  Most of the menu items (including Quit) are greyed out,
and those that aren't produce an error beep.  Only recourse is to Force Quit.

it shows up as a sheet for me when i do this. i can't dupe it.

Sorry, that's a bad test case.  I forgot one step:

1) Set tabs to open in background
2) Set to "Ask before storing" cookies
3) **  Right click on URL above and open it in new tab.  **
4) Since the site is opening in the background, the cookie confirm dialog will
load as a dialog window, rather than a sheet.
5) Press Cmd-W to close the dialog (rather than clicking Yes or No, or hitting
escape).

After this, browser is completely unresponsive and need to force quit.
that's what i did and it still WFM
Really?  Tab opens behind current one?  And cookie dialog still appears as a
sheet?  I can reproduce this everytime.
