Details

When, because there are two many tabs in the front window, command-click opens a new window in the background instead, the background window is the active one. That is, instead of affecting the front window which one is reading, the mouse and all other controls affect the newly opened background window. For instance, if I scroll, the background window scrolls, not the top window. If I close the window with command-w, it is the new background window that closes, etc.

What build? I fixed something like this in a recently nightly build (after .6).

Does seem to be working now. (Although I still wish there was some way to make all the tabs stay in one window!)
