By setting app.update.log to true and running the backgroundupdate with firefox --attach-console --backgroundtask backgroundupdate it can be observed, that backgroundupdate detects the presence of the service and decides to use it and even if I deactivate the service on Windows I get:

*** AUS:SVC isServiceInstalled - returning true
*** AUS:SVC shouldUseService - returning true
*** AUS:SVC getCanApplyUpdates - bypass the write checks because the Windows Maintenance Service can be used

and I believe that it should not try to use the service when its disabled.
