Under IE there is always a scroll bar displayed on the right edge - tho it is
greyed out if it is not needed. This is useful because it means for short
vertical pages the design of the site does not 'jump' when going form a short to
a tall page.

Have a disabled scroll bar on the right of the browser window when page fits
entierly inside window

Adding to the UI to prevent inconsistent page rendering is the olnly possible
method - there is no garunteed way to acheive the effect with markup.
Can you explain what you mean by "doesn't really seem like sane UI"?
