right-click off tab cripples menu when released on tab

If you right-click within the body of a page and hold the right mouse button
down as you drag the mouse to the actual tab, you correctly receive a tab
context menu.

However, quite often if you then click "Close Tab", the tab fails to close.

Reproducible: Sometimes
Steps to Reproduce:
1. right-click within the body of a page (images seem to work best)
2. holding down the right mouse button, position the cursor over a tab
3. select "Close Tab" from the context menu

Actual Results:  
Tab often (not always) fails to close

Expected Results:  
Tab should have closed

Clean install, fresh profile.
On the occasions that this does fail I get the following in the JavaScript Console:

Error: uncaught exception: [Exception... "Index or size is negative or greater
than the allowed amount"  code: "1" nsresult: "0x80530001
(NS_ERROR_DOM_INDEX_SIZE_ERR)"  location:
"chrome://global/content/bindings/tabbrowser.xml Line: 833"]
i just did it on a blank tab, and it closed the tab before it.  similarly,
starting in the current tab, then moving to an unselected tab and clicking close
tab caused the current tab to be closed.
