Details

After downloading one of the custom themes in Tools-Themes menu, I was unable to
apply the new theme because the "Use Theme"  button is grayed out (disabled).

I am using this version of Mozillaaa Firefox:
Mozilla/5.0 (Windows; U; Windows NT 5.1; en-US; rv:1.7.5) Gecko/20041107 Firefox/1.0
what theme? Did you select the theme (with a left click) before trying to Use
theme? Did you restart afterwards?
