User-Agent: Mozilla/5.0 (Windows; U; Windows NT 5.1; pl-PL; rv:1.8.1.5) Gecko/20070716 MultiZilla/1.8.3.3a SeaMonkey/1.1.3 Mnenhy/0.7.5.0
Build Identifier:

The mozilla.pl domain is in the hand of the polish "Sylaba sp. z o.o." corporation located in Poznan and they hadn't made probably any steps to give this domain to the hand of the polish community or Mozilla Europe (Aviary.pl Translation Team tries to take over the domain since 2003).

Reproducible: Always
Aviary.pl didn't even exist in 2003. To make the situation clearer here:

1) Sylaba is the company that used to localize Netscape 4 (rebranded to 'Sylaba Komunikator) some years ago, and mozilla.pl is where they used to put it
See e.g. http://web.archive.org/web/20010217103738/http://www.mozilla.pl/

Currently the domain hosts a static page that says "site unavailable", but it's still theirs.

2) One member of the MozillaPL.org Forum community (not of the localization team) talked to them about this in 2003, but without any conclusion, because they wanted to talk with somebody more official (note that 2003 is the time of a crisis inside the MozillaPL.org team, which led to the creation of Aviary.pl - so at that time the Polish team didn't actually have anyone to take care of this a bit more officially).

3) The domain is on the appropriate list in the Mozilla Europe internal wiki (trac), I don't know whether Mozilla Europe's lawyers tried to reach to Sylaba at all, though.

Two years later:

- mozilla.pl domain still owned by Sylaba
- now it redirects to the Polish community site, www.mozillapl.org
- I own a so-called "option" [1] for this domain, which means that if Sylaba decides not to/forgets to renew this domain, I can buy it before anyone else (currently my option for mozilla.pl is valid until December 2011).

Thanks for the update Marek. Can we mark this RESOLVED?
We can't mark this resolved. The domain is still owned by a third-party company (though they're nice enough to redirect the visitors to our community site).

I would prefer a Mozilla entity (be it Mozilla Europe, MoFo, MoCo, Mozilla Messaging, or what else) or the Polish l10n team to own the domain, not Sylaba.
Oh, this bug was originally filed (and still is) in the "trademark violations" component. It's only a trademark violation if you consider owning the domain to be a violations and the Sylaba company doesn't do anything really evil with this domain. I'm not sure if there's a more appropriate component for domain name issues, though.
Resetting bug as Julie Martin is no longer with Mozilla.

I checked and mozilla.pl currently returns a 404 Not Found message. It is still registered to Sylaba. We would prefer MoCo own it. Marek - Is it possible for you to transfer your option to MoCo? Since Sylaba has been friendly, I think we could send them a note from MoCo or our outside counsel asking them in a nice way to transfer the domain name to us. Sounds like they might well comply.

It should be. I'll check it with my registrar.
Sorry, totally forgot about this. I will get back to it when I'm back in Poland next week.

The situation got worse - they don't redirect to the community site anymore, providing their own content.
I can't tell if the same company still owns the name. The whois info says:

yes. Gratka is the new owner of Sylaba.
I should get the authinfo for the option this week.

I also own mozilla.net.pl, camino.org.pl and mozilla.org.pl domains (real domains, not options) and some others. I'd be happy to transfer these to Mozilla as well, as I don't really want to pay yearly fees for these domains anymore.

I've received the authinfo for my option for the mozilla.pl domain. Please let me know where to send it.
Liz, is Mozilla still interested in transferring the option from me? My option is currently valid until December 2014, but I don't intend to extend it beyond that term.
server-ops handle domains, AFAIK - that's probably a better queue for this.

Gavin, I'd like to transfer the *option* for the domain (comment 2), not the actual domain which still is owned by a third-party entity (comment 13).
WebOps, do we have an account that can take ownership of the option to buy the domain mozilla.pl, per comment 15?

(Comment 12 mentioned some other domains, so I made the summary a bit generic.)
Yeah, if we're in a position to actually move on it, Server Ops can take this. It only needs to be in Legal if there's a UDRP necessary or if we need a lawyer to politely ask them to hand it over. If they're already willing, we just need the domains unlocked and the auth codes handed over. (You can email them to me or one of the webops guys directly, don't put them on the bug).
We're not aware of any obvious way that we (WebOps) can properly take ownership of the *option* to buy a domain in the future. We can definitely easily take the actual domain at some point, but I don't know how to take the option to buy the domain.

This may be something we can discuss with our registrar.

Yes, I think checking with Audra at MarkMonitor would be a good idea.
To keep this bug clear, I'll file a separate bug for the domains I actually own (that were only mentioned as a side note in comment 12).

Gratka.pl renewed the mozilla.pl domain until 2014.01.28, currently there is no html content served from this domain anymore.
The mozilla.pl domain is now owned by Polskapresse (subsidiary of the German publisher Passauer Neue Presse), who acquired Gratka.

Contact data for Polskapresse can be found here:
http://www.polskapresse.pl/kat/28.html

Note: my option is due to expire in December 2014 and I am not going to renew it. It seems useless to me, as long as Sylaba/Gratka/Polskapresse keep renewing that domain every year.
Nonetheless, if you still want the option, let me know while I still have it. This doesn't change the fact that Polskapresse own this domain now and they need to be contacted by Mozilla.

Still, 6 years have passed since this bug was originally filed and it seems nobody truly cares about this domain other than some members of the Polish community, otherwise some actions would have been taken... :(
Lets see if moving this to Community IT helps move things along.

comment 21 and 22 actually point that our Webops engineers can help, after talking to Markmonitor.
I'll move the bug back into their queue.

Any action to obtain the domain would require us to obtain outside legal help and given that the Publisher is not using the site in an abusive way, we don't think the time and costs associated with taking over the domain would be the best use of resources.
