My comment: May be. Because transitional DTD might be thought of as a 
compatibilty DTD.

Note: My fix ( matter of enabling a flag ), for beta2, would be to disable 
transitional DTD, however, for beta3 I can make HTML 4.01 Transitional to 
trigger the transitional DTD.
