This is a clone of bug 477851.
In aboutRights.dtd, there's currently a following entity
<!ENTITY rights.webservices-term3 "The Services are provided "as-is."
&vendorShortName;, its contributors, licensors, and distributors, disclaim all
warranties, whether express or implied, including without limitation,
warranties that the Services are merchantable and fit for your particular
purposes. You bear the entire risk as to selecting the Services for your
purposes and as to the quality and performance of the Services. Some
jurisdictions do not allow the exclusion or limitation of implied warranties,
so this disclaimer may not apply to you.">
Correct me if I'm wrong, but I think it should say "whether expressed or
implied" instead of "whether express or implied" in the first sentence.

You're wrong ;)
Google's numbers seem more variable than usual, but in the neighborhood of 119,000 "whether expressed or implied" and between 500,000 and 1,450,000 "whether express or implied."
Not only is it legal language, which in English does pretty much whatever it wants, it's also the name of a class of warranties, express warranties rather than expressed warranties. You would be correct if the sentence was eliding some words from "disclaim all warranties, whether those warranties were expressed or implied" but it's actually "disclaim all warranties, whether of the class known as express warranties or the class known as implied warranties."
