I have found this while building fennec (xulrunner + fennec UI) where we do a 'make package-tests' in the xulrunner objdir and we include all the mochitest/browser/* tests. These tests are Firefox specific tests and should not be included in a xulrunner package-tests.
FWIW, the bug is not "we shouldn't package them", but "we shouldn't be copying them to the objdir if we're not building Firefox".
I'm assuming this bug is now moot since xulrunner is gone.
