Several people reporting that legends inside fieldsets behave differently with 3.6. With our internal app, the legend is mashed at the top now. FF 3.5X and IE work fine.

That particular test case is covered by bug 450418.
(and is a side effect of bug 269908)
That, plus the fact that in 3.6 we started enabling absolute positioning of <legend>, which had previously been disabled.
