Menu Bar can get on top of tabs even when Tabs on Top is checked

When Tabs on Top is selected, the tabs are located above the Menu Bar. however, if you hide and re-show the Menu Bar, it gets on top of tabs. 
when the Menu Bar is hidden, pressing Alt would also show the Menu Bar on top of tabs.

I'm not sure which is the correct behavior, but this is inconsistent and confusing. either have the Menu Bar always on top, or let the Tabs on Top be always on top of menus.

Reproducible: Always

Steps to Reproduce:
1.Right click the toolbars and select Tabs on Top (if it isn't selected). this will bring tabs on top of menubar.
2.Right click the toolbars and uncheck Menu Bar.
(2.5. press Alt twice and see what happens)
3.Right click the toolbars and recheck Menu Bar. it is now on top of tabs.
