On firing up firefox an error reporting that firefox is still running is presented.  going into task manager reveals that this is not the case.  Also seems slower than the previous version.  here were no extraordinary circumstances and no knowledge of how to reproduce as it was still erroring after 3 reboots.

Sounds like your profile is still locked from not being closed correctly. Try following this guide.
