Can you reproduce this failure Aaron? I wonder if that happens because we are retrieving an element from a background tab.
Completely intermittent. Perhaps there's an issue with getting elements in background tabs, as I filed something familiar in testCloseWindow @ bug 607000

Yes, the solution on bug 607000 makes totally sense.
