According to Bug 645707 FGLRX with OpenGL version 3.0 and higher is whitelisted. ATI Radeon HD 4600 is from R700 family and supports OpenGL 3.3.

glxinfo shows:

OpenGL vendor string: ATI Technologies Inc.
OpenGL renderer string: ATI Radeon HD 4600 Series 
OpenGL version string: 1.4 (2.1 (3.3.10665 Compatibility Profile Context))
OpenGL extensions:

I use Ubuntu 11.04 with latest FGLRX driver.

You don't have OpenGL 3.3, you have OpenGL 1.4 according to the 'OpenGL version string'.

Though, I have to confess that this version string, with nested parentheses, is extremely confusing. Any link about how to interprete it?

I found out that this version string shows when Direct Rendering is disabled.
I've fixed it as described in http://ubuntuforums.org/showthread.php?t=1449620 (removed libgl1-mesa-glx and installed libgl1-mesa-swx11)

glxinfo shows now:
