This has been happening quite some time, but no mention of it in Bugzilla when I looked for it. In 2001022113 MacOS build trunk, Send failure of Mail and News messages does not result in the messages stored in Unset Messages folder. Currently, it has no use. Therefore, bug 55236 is pretty severe when send fails.
We save messages in the Unsent Messages folder only when utilizing the Send Later command. (File|Send Later, offline usage will also default to send later.) Correct it is that there are some issues (and several outstanding bug reports besides the one you mentioned) about how various send failures may be handled, but we do not automatically store them in Unsent. I would say this is a "wontfix" or "invalid" by design, but I'll let development decide what resolution to give this bug report.

I think that unsent messages (because of message send failure) should warn and return the user to the compose window. This is the current behavior I believe and the correct behavior.
Maybe I should mark this as RFE, then. Unless bug 55236 is fixed, I would say this feature is pretty important.
