when using the awesome bar it should maintain whichever state it was in when you left. if you navigate to a site from your top sites when you touch the awesome bar again it should take you to the tops sites tab. when you navigate from the bookmarks tab it should take you back to the bookmarks tab and same with history. right now it returns you to top sites by default no matter where you were previously

Yes, let's keep the XUL behaviour, where we always return to "Top Sites" While generally it is helpful for a menu to remember your last visit, the most useful thing we can show a user when they start new task in Firefox is the Awesomebar's frecency-based Top Sites list. So if we were to remember the tab you visited before you left the menu, you would have to manually go back to that list, making it somewhat less useful.
Then this is wontfix per-UX.
