Today's mozilla build tries to be "always on top." (the tar.gz, not the installer.)

Recreate as folows:

start mozilla and browse a bit, click somewhere in the layout window and Ctrl+n

Wait a second and the new window will jump to the back.

This also happened with Edit | Preferences.

I also was able to start a "war" going by telling the initial window to move to
the back... the two browser windows tried to get the front view and I had to
kill mozilla.

I'm using sawfish with no mozilla-window-history saved under Ximian GNOME.
er.. You mean "yesterday's build" right?  This is fixed in today's (March 20)
builds.
