Steps to reproduce
1. Switch to private browsing using shift+cmd+p
2. Click on "Start Private Browsing" if the dialog appears
3. Note that the Tools menu item is hightlighted

This does not happen if you go to Private Browsing using the mouse

That's because you are using keyboard combination to go into private browsing, and the "Tools" contains "Start Private Browsing" menu item with the keyboard combination. I also see that Tools menu is no longer highlighted when in the private browsing mode. It's the same for other keyboard combination e.g. cmd + T, you would see a flash of the "File" menu.

I think this bug is invalid.
BTW, I just see a flash and the highlight doesn't stay on "Tools" menu.

For me it stays highlighted. I seen this behavior in 2 different computers. It does not always happen and it can also happen to other menu root items. This bug is valid.
