You have to CC them first, and then needinfo? them.  This restriction seems unnecessary.
This is actually not specific to Needinfo and is an issue with setting flag requestees in general. It doesn't currently check to see if the user is being added to the Cc list before throwing an error if the user is used as a requestee. I will see if I can take a look at this soon.
