Verified as fixed on the latest Fenix Nightly build 122.0a1 from 12/8 with Google Pixel 6 (Android 14), and Samsung Galaxy Note 8 (Android 9).
The GPC is always enabled in private browsing, and only enabled in normal browsing when the corresponding setting from ETP settings section is enabled ("Tell websites not to share & sell data").
