Details

Environment: Device: Nexus 4 (Android 4.4.4); Build: Nightly 36.0a1 (2014-10-29); Steps to reproduce: 1. Launch Fennec; 2. Long tap on any entry from about:home; 3. Without releasing the tap swipe left or right. Expected result: The about:home panels can not be swiped behind the context menu. Actual result: The about:home panels can be swiped left or right behind the context menu. Notes: Please check the video: http://youtu.be/5CL629oFsW4
Wild guess is that this is probably inherited from Android and not much one can do about it.
I'll won't fix this: As long as this does not result in a more serious issue (Something like clicking on the context menu while on a different tab has an undesired behavior) then it's unlikely we are going to fix this.
