menu action key equivelents do not work if no open window

Details
when working with Mozilla, in th efollowing environments:
Win 98, Mac OS 9.0.4, Mac OS 9.1, Mac OS 9.2.1, and Mac OS X (10.0.3, and 10.1)
If there is no open window (of any sort, browser, email etc) keyboard initiated
menu actions (Command - N as an example), do not function.
i like the win98 platform. no window open => app not open => keys not work :)
