apple-W doesn't close tab when the tab is empty

when a tab doesn't have valid data in it. for example after trying to download a
file with "open in new window" the tab cannot be closed with Apple-W shortcut.
Reproducible: Always
Steps to Reproduce:
1. open window - with tabs
2. try to get an empty tab which doesn't contain data (example download in
another window with "open in new window")
3. push Apple-W - no effect
Actual Results:
the empty tab that i want to close doesn't close - i have to click the X at the
right side of the tab-list.
Expected Results:
close the tab

WorksForMe using FizzillaCFM/2002082909 on 10.1.5. thomas, set Mozilla to open
new windows as blank, create a new (now blank) tab, and try command+w. Does it work?
