in some skins, it uses the native menus for phoenix, but not by default. Could
you make the menus be drawn by the OS by default?

This is not a theme issue, it's an issue with the XP (cross-platform) toolkit
widgets for drawing menus, which is not using the OS widgets. As a result, theme
authors have to choose a fixed style for the menus, either the Windows Classic
one with 3D borders, or the WinXP style with blue highlighting and no 3D borders.
This is probably a dupe of bug 39403. Bug 39375 is a relevant tracker bug.
