The download page for Camino 1.6 claims that 'By installing Camino, you agree to our End-User License Agreement.'. This is clearly iniquitous, since many users will never have seen this download page (e.g. sparkle users, users following a direct link), and so they will not have had an opportunity to even know the agreement exists. I find it hard to imagine that your claim that the user has agreed to it would stand up in any jurisdiction that you care about. And putting silly legal claims like this on your website makes Camino look bad.
If you really need the user to agree to this, I suggest popping up a window containing the agreement on first run. Then you could set a flag, userAcceptsLicenseAgreement=1 in the user defaults. The user would never have to see it again, even through upgrades, unless the text of the agreement changed.

When you download Camino, then open the .dmg, the first thing that pops up is the EULA. That is, before you can copy Camino.app to your HD; you have to click 'Agree' before continuing. Users who download through Sparkle already have Camino installed.
Or am I missing something ?

That's not true as of 1.6; we removed the EULA from the dmg because Sparkle couldn't handle it and we wanted to be able to use the same dmg for both.

Where are we on this? Does MoFo need us to do what Ben suggests in comment 1, or are we OK with having nothing (in which case this is a simple site change)?
