This should be dup of bug 452385 that was already fixed now (you can test with 20080910xxxxxx build and later). And note that <panel> elements are not top-most window on Win32 and MacOS, if the <panel> element should be topmost window, extension developers need to add |level="top"| to the <panel> element.
