From my understanding, bug 292591 added some null checks in nsXBLBinding::AllowScripts, and then bug 308328 fixed a real bug that was causing crsahes (bug 311332). Somehow, bug 311332 was left open to track maybe removing the null checks. At least, I think those are the null checks the last few comments in bug 311332 are talking about. It's hard for me to tell.
