Spun off bug 569652. The attached WIP timed out (intermittently) on Try.

(Note: we also have some menu fragility in our tree tests - bug 527646)
we have mochitests for menus: events and tree tests (tree/test_menu.xul, treeupdate/test_menu.xul, events/test_menu.xul), nothing to do here I think.
