Tablet: Asus Eee Transformers - Android 4.0.4
Phone: x86 ZTE -Android 4.0.3 - HW Menu Button 
       Galaxy Nexus - Android 4.3
       HTC Desire HD - Android 2.3 - HW Menu Button 

Steps:
1. Go to any address (ex. mozilla.org)
2. Tap the URL
3. Press Menu button

Actual Results:
- on HW buttons trigger the menu options even if this is unavailable for phones without HW button (option is grayed out)

Expected results:
-  on HW buttons should not trigger the menu options as this is unavailable for phones without HW button (ex. Galaxy Nexus, Asus Transformes)

Note:
- reproducible on all platforms

On ZTE x86 this is awkward as it is displayed over the Keyboard.
On Other devices mentioned(HTC Desire HD and Note - the keyboard is retracted)
