I would assume that the js implementation must behave like the cpp implementation and not fail the test?

It should, though it may uncover test bugs due to slightly different timings.
For this bug, it's AFAICT quite rare and intermittent (only totaly 2 test failures ever), and no idea if it's related to the quoted landing.
