When merging ScrollLayer wrapped display items, currently the first (see bug 729534) frame is used. It's possible that this frame could change and cause the associated ThebesLayer not to be retained.

Feel free to re-title this bug more accurately, I may have misunderstood the problem slightly.
Arbitrary is the wrong word... We changed the merge code to swap frames though, which makes more sense when merging scrolllayer items (as the 'lowest' frame is more likely to remain the underlying frame), and the work in bug 795674 means that this shouldn't matter anymore anyway. Closing as wontfix.
