Steps to reproduce:

In OSX fullscreen mode (and presumably elsewhere), the new scrollbar fades away when my mouse is on the gutter's rightmost column of pixels (i.e. the right edge of the screen).

This seems to apply to non-fullscreen mode as well. In Safari, scrollbars even stay in hovered state until the mouse is inside the browser window, but off the scrollbar. In other words: if the mouse moves over the scrollbar to make it appear in hovered state, then moves out of the browser window all together, the scrollbar persists in hovered state.
