The mail.tabs.loadInBackground preference should not affect the using middle click and the context menu to open a message a new tab.

Currently the mail.tabs.loadInBackground preference when set to false updates the behavior of all actions that open a message in a new tab. Following common UX guidelines, it is appropriate for the preference to not affect the middle click and context menu actions that open a message in a new tab, since we have the shift + action option to allow for the opposite effect.
